Data Signal Terms of Use

Agreement to these terms

These Terms and Conditions (Terms) govern your access to and use of the Data Signal mobile application, website, and related services (collectively, the Services) provided by JAS Intelligence LLC, doing business as Data Signal (Data Signal, we, us, or our). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Services.

Company information

Eligibility and use of the services

You may use the Services only if you can enter into a legally binding agreement and comply with applicable law. You are responsible for your use of the Services, your account activity, and the accuracy of the information you provide.

Data Signal provides news, summaries, signal analysis, personalized content, article drilldowns, subscription-based access controls, and related product features. We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, subject to applicable law.

Accounts and authentication

Certain features require an account. You are responsible for maintaining the confidentiality of your login credentials, device access, and account session.

We may allow sign-in through third-party authentication providers and may restore your session on a returning device through secure device storage or comparable authentication mechanisms. If you believe your account has been accessed without authorization, you should contact us promptly at support@thedatasignal.io.

Subscriptions, billing, and access limits

Some parts of the Services are available only through a paid subscription. Free users may be subject to usage limits, including article or drilldown limits, while paid users may receive expanded or unrestricted access depending on the subscription tier in effect.

Subscription purchases made through the iOS app are processed through the Apple App Store and related subscription infrastructure. Billing, renewals, cancellations, refunds, and payment disputes are therefore subject to Apple’s applicable rules and terms.

Data Signal does not offer refunds or cancellations outside of standard App Store handling. If you purchase through Apple, any refund or cancellation rights will be governed by Apple’s policies and any rights required by applicable law.

We reserve the right to change pricing, plans, access limits, trial structures, promotional terms, and feature availability at any time, subject to applicable law and any obligations owed to current subscribers.

Acceptable use

You agree not to misuse the Services. In particular, you may not:

We may suspend or terminate access if we reasonably believe you violated these Terms or created risk for the Services, other users, or third parties.

Content and third-party sources

The Services may include summaries, commentary, analysis, links to third-party articles, and other informational materials. Third-party content remains the property of its respective owners.

Data Signal is intended for informational purposes. It is not legal, financial, investment, or professional advice, and you remain responsible for how you use information obtained through the Services.

When you leave Data Signal to view third-party content, your interactions with those third-party sites or services are governed by their own terms and policies.

Intellectual property

The Services, including their software, design, branding, layout, text, graphics, compilations, and proprietary features, are owned by or licensed to JAS Intelligence LLC and are protected by intellectual property and other applicable laws.

Except for the limited right to use the Services in accordance with these Terms, no rights are granted to you. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Services except as permitted by law or with our prior written consent.

Privacy

Your use of the Services is also governed by the Data Signal Privacy Policy. By using the Services, you acknowledge that we may collect, use, and disclose information as described in that policy.

Account suspension, termination, and deletion

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if necessary to protect the Services or other users.

If you request account deletion, we may deactivate or remove your account access while retaining certain records where reasonably necessary for legal compliance, fraud prevention, dispute resolution, service integrity, or legitimate business recordkeeping. Data Signal may preserve certain meter or historical records even after account deletion.

Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.

We do not guarantee that the Services will always be uninterrupted, secure, error-free, current, or available, or that all content, summaries, analyses, or access-control functions will always be complete or accurate.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAS INTELLIGENCE LLC, DATA SIGNAL, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF US$100 OR THE TOTAL AMOUNT YOU PAID TO US, IF ANY, FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless JAS Intelligence LLC, Data Signal, and their affiliates, officers, directors, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the Services, your violation of these Terms, or your violation of applicable law or third-party rights.

Governing law and venue

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.

Subject to the arbitration section below, any dispute arising out of or relating to these Terms or the Services shall be brought in the state or federal courts located in Ohio, and you consent to the jurisdiction of those courts.

Arbitration agreement

Please read this section carefully. It affects your legal rights.

To the fullest extent permitted by law, you and JAS Intelligence LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or the relationship between you and us that cannot be resolved informally will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.

The arbitration will be conducted on an individual basis by a neutral arbitrator and not as a class, consolidated, or representative action. You and we each waive any right to a jury trial to the extent permitted by law.

If any part of this arbitration provision is found unenforceable, the remaining parts will remain in effect to the fullest extent permitted by law.

Changes to the services or these terms

We may update the Services and these Terms from time to time. If we make material changes, we may update the effective date and provide notice where appropriate. Your continued use of the Services after revised Terms become effective constitutes your acceptance of the revised Terms, to the extent permitted by law.

App Store terms

If you access the Services through Apple’s App Store or another third-party platform, your use may also be subject to that platform’s rules and policies. These Terms are between you and JAS Intelligence LLC, not with Apple or another platform operator, except where a platform’s mandatory provisions apply.

Regional consumer rights

If you live in a jurisdiction that provides mandatory consumer protections, nothing in these Terms is intended to limit rights that cannot lawfully be waived. This includes applicable rights that may exist under U.S., California, UK, or EU consumer laws.
